Chapter Summary


This chapter discusses bonds of guardians and conservators. It covers the circumstances under which a bond is required, bonds of joint guardians or conservators, waiver of the bond, contents of the bond, and determination of the amount of the bond. The chapter also reviews surety liability, substitution, and discharge. Finally, the chapter examines reductions or increases in bonds, including applications to reduce bonds, bond reduction by deposit in a blocked account, additional bonds for real property sales or mortgages, motions for further security, and ex parte applications to increase bonds.

The chapter contains several forms to aid the practitioner, including a notice of motion to reduce the amount of the bond, with a supporting declaration setting forth the condition of the estate, and an order reducing the bond; a receipt for property deposited, to reduce the amount of the bond; and a notice of motion to require further security, with a supporting declaration and an order requiring further security.
