ABSTRACT TEXT:

This chapter discusses the law of fixtures in the landlord-tenant context. It defines fixtures and trade fixtures. It discusses the tests for determining whether personal property annexed to real property is a fixture, the right to such annexed property as between landlord and tenant by operation of law and by agreement of the parties, and the rights of third party claimants. The chapter also discusses the removal of fixtures and the enforcement of rights in fixtures, including remedies for wrongful removal.
