ABSTRACT TEXT:

This chapter discusses the purpose, function and essential characteristics of wills and the preparation and drafting of wills and codicils. The Legal Background section covers the general law relating to wills, including discussions of pertinent tax considerations and probate matters and the law related to the modification, supplementation, or revocation of a will by a codicil. It gives brief attention to proving capacity of a testator. The Practice Guide contains a list of information and documents necessary to initiate an estate plan, and a drafting guide for wills, with extensive cross-references to provisions that may be included in a will.

It also contains a guide to the correct procedures for preparation and execution of both wills and codicils and procedures to be followed subsequent to the execution of a will to carry out an estate plan. The forms in this chapter consist of a number of complete wills and codicils selected to illustrate the basic types of simple and complex will available, accompanied by discussion of tax consequences of each, when applicable.
